14. SUBSCRIPTION AND CONTRACT
14.1. Meaning of terms
The general business conditions of the service provider represent a list of contractual clauses,
the application of which the parties refer to in the contract.
The contract is the contract on the establishment of a subscription relationship concluded by
the service provider and the user. A signed and properly completed purchase order, or a
properly completed and certified document with indicated package prices, also constitutes a
contract on the establishment of a subscription relationship. Upon receipt of the certified
document with the package order, the service provider will notify of receipt and assign an
order number based on which the service invoice will be issued. By signing the Agreement or
Purchase Order, the user accepts the terms of use of the services set forth in these General
Terms and Conditions. Every Contract or purchase order states that by signing it, the user or
subscriber accepts these Terms. In the event of any inconsistency between the written offer
and the General Terms and Conditions, the General Terms and Conditions shall prevail, unless
otherwise agreed in writing. Contracts/offers/orders concluded between the user and the service
provider(or accepted by the user) may have specific attached provisions. In such cases, those
provisions will apply to the business relationship (contract/order/offer) between the user and
the service provider. These provisions may be delivered in the user's language or in the user's
language with a German translation.
Subscriber or user is a legal or natural person outside of their trade, business, craft or
professional activity who enters into an agreement with the service provider on the
establishment of a subscription relationship.

which supplement the contract and are binding as contractual provisions.
Subscription is the price paid by the user to the service provider for using the services.

14.2. Standard subscription

Invoices for all services that the service provider calculates for the user based on the contract

If the user does not settle the bill on time, the service provider reserves the right to calculate
default interest.
14.3. Subscription renewal
Presentation on the portal is renewed automatically after the expiration of the selected
package for the same pre-agreed time period. If the existing user wants to cancel the
contract/order, he can do so only in writing by registered mail to the address of the
headquarters Werinherstraße 3, 81541 or to the e-mail address
eto@europeantourismorganization.eu, after all invoices from the previous period have been
settled. The business relationship between visitors
and users on and off the site of the service provider is exclusively a matter of business
agreement between visitors and users. ETO is not responsible for any damage caused by

14.4. Start of subscription
The conditions for starting to use the subscription are: a valid subscription agreement or a
valid purchase order.
The date of signing the contract by the user is considered the beginning of the subscription.
14.5. Duration of the subscription relationship
The subscription relationship is based on a certain period of time with automatic renewal with
the possibility of termination, unless otherwise defined by the contract.
14.6. Termination of subscription - termination of contract
Each contracting party may terminate the contract or order without the obligation to state the reasons
for termination in accordance with the General Terms and Conditions agreed upon by the user at the
time of signing the Contract/Order. The user may terminate the contract/order (whether it is a
paid subscription, mutual compensation, banner exchange, etc.) within 8 days from the date of
signing the contract/order with the service provider without providing any reasons, whereby the
service provider will not charge any cessation fee. In case of unilateral termination of the
service by the user after the expiration of 8 days from the date of signing the contract/order, the
service provider will charge the user the amount of all remaining fees for the remaining mandatory
duration of the contract/order. The party terminating the contract must deliver the notice of termination
to the other contracting party in written and certified form by an authorized person via electronic
mail or registered mail to the headquarters address of the service provider.
14.7. Additional update billing terms for all users
ETO will make any update within 5 days of receiving the request. If the user marks the request
as urgent, the service provider will update it within 48 hours of receiving the request.
15. TERMS OF DELIVERY OF MATERIALS AND LIABILITY FOR DEFECTS
The user is obliged to deliver the material he wants to promote within 10 working days from
the date of delivery of the certified purchase order or contract. If the user submits the
prepared material within the given period, the service provider undertakes to install it within
30 working days from the day of receipt. The duration of the contractual relationship begins to
run from the date of signing the contract/order by the user. If the user does not deliver the
material within 10 working days from the day of the order, heconfirms his consent to the publication
of only the name and address (profile photo, logo or name of the user, white background, black print)
that he delivered to the service provider with full payment of the price of the agreed package.
Invoices will subsequently be issued and submitted for delivery electronically. The user who
has not delivered the material will have the right at any moment of active business
cooperation to deliver the material subsequently, and the service provider will not charge him
for the subsequent delivery. ETO reserves the right not to publish ads with inappropriate
content or those that lead to pages of such content or if it does not meet technical standards.
The user is obliged to respect the technical conditions of the presentation of the contracted
package and assumes responsibility for any technical defects of the delivered materials. The
service provider is obliged to warn the user once about possible technical defects if he notices
them during installation on the site, and the user has the right to one free change within 10
working days in that case. This free change does not apply to additional free contracted
updates. The service provider has the right to charge for the contracted service regardless of
technical difficulties during the installation of materials due to defects provided by the user.
The service provider reserves the time-limited right to use and publish the submitted material
even after termination of the contractual relationship with the user. Photos can also be used
as covers in the text.
15.1. Provisions on the quality of materials
ETO always strives to ensure a clear and high-quality visibility of the site to the public.
Therefore, it instructs its users to submit images of minimum dimensions: 1024*683 px for the
main gallery. ETO will check the quality of the photos during upload. If the quality of the
uploaded photo in the main gallery will be reduced, the user will be warned. The user will
then, within 10 working days from the day of the service provider's warning, submit a new
photo of appropriate dimensions or the service provider will place that photo in the
presentation along with the appropriate text or at the bottom of the presentation. For the
profile photo, submit images of minimum dimensions: 800x627 px.
16. PROTECTION OF PRIVACY
The user has the right to request a review of all personal data submitted to the service
provider. The service provider has the right to update, correct or delete this data (if any) at
the request of the user, which is submitted by e-mail.
